1. The agreement

These Terms of Use (“Terms”) apply to the Tapioca app, its widgets, the Tapioca server features and this website (together, “Tapioca”), provided by Rainforest Apps (“we”, “us”). Tapioca was called Reps before version 1.0.1; these Terms apply to it under either name. By downloading or using Tapioca, you agree to these Terms and to Apple’s Licensed Application End User License Agreement (“Apple EULA”), which governs your licence to the app. These Terms add to the Apple EULA. Where the two conflict about your licence to the app, the Apple EULA applies. Our Privacy Policy explains how we handle data.

If you don’t agree, please don’t use Tapioca.

2. Who can use Tapioca

You must be at least 13 years old to use Tapioca. If you’re under 18, or under the age of majority where you live, you may use Tapioca only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

3. Tapioca Pro subscriptions

What it includes. Tapioca Pro unlocks the app’s features, including the ready-made decks, every kind of card, the widgets, AI card writing and iCloud backup. Tapioca has no free tier and no free trial.
Billing. Subscriptions are purchased through Apple and charged to your Apple Account when you confirm the purchase. The price and billing period are shown before you buy.
Automatic renewal. Subscriptions renew automatically at the same price and for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
Managing and cancelling. Manage or cancel in your Apple Account settings, or from Profile › Settings › Manage subscription in the app. Cancelling stops future renewals, and Pro stays active until the end of the period you’ve paid for.
Refunds. Apple handles all payments and refunds under its own policies. We can’t issue refunds directly. You can request one at reportaproblem.apple.com.
Price changes. We may change subscription prices. Apple will notify you of any change as its rules require, and where required, ask for your consent before renewing at a new price.
When a subscription ends. The cards and decks you made stay on your iPhone and can be exported at any time. Features that require Tapioca Pro stop working until you subscribe again.

4. AI card writing

How it works. AI card writing is an optional Tapioca Pro feature. With your permission, the content you choose is sent to our server and to Anthropic to generate flashcards, as described in our Privacy Policy. It needs an internet connection.
Import checks. When you import a file or paste a list, a short sample of the text Tapioca read is sent the same way, so the cards can be checked and the layout worked out. The file itself isn’t uploaded, and importing works without the check, as described in our Privacy Policy.
Fair-use allowance. AI card writing is included within a monthly fair-use allowance, which protects the service for everyone. When the allowance is reached, AI card writing pauses until the next month. We may adjust the allowance over time, and AI card writing may not be available in every country.
Check what it writes. AI-generated cards can be incomplete, out of date or wrong. Review cards before relying on them, especially for exams, medical, legal, financial or safety-related topics. AI output is not professional advice.
What you send. Only send content you have the right to use. Don’t send content that is unlawful, infringes someone else’s rights, or includes other people’s personal information without permission. You must also follow Anthropic’s Usage Policy.
Your cards. As between you and us, the cards generated for you are yours to use, subject to any rights others hold in the material you sent.

5. Your content

You own the cards, decks and notes you create or import (“your content”). Your library is stored on your device and in your own iCloud Drive, not on our servers. You give us permission to process your content only as needed to provide the features you use, such as sending the content you choose for AI card writing. You’re responsible for having the rights to anything you import, including decks made by others.

Keep your own backups. Tapioca provides iCloud backup and export tools, but we can’t recover a library that was deleted from your device and your backups.

6. Ready-made decks

The ready-made decks are provided for your personal study. The deck text and our own illustrations are owned by Rainforest Apps. Pictures from other sources are used under their licences, and their sources and licences are listed on our picture credits page. We check the decks carefully but can’t guarantee every fact is complete or current. If you spot a mistake, please tell us. You may not extract, redistribute or sell the decks outside the app.

7. Acceptable use

When using Tapioca, you agree not to:

break the law or infringe anyone’s rights;
copy, modify, reverse engineer or redistribute the app, except where the law allows despite this restriction;
get around subscription checks, the AI allowance or other limits;
access our server or AI features other than through the app, or overload, probe or disrupt them;
use Tapioca to generate harmful, deceptive or abusive material.

We may suspend access to server features, such as AI card writing, if these Terms are broken.

8. Our app and trademarks

Tapioca, its design, code and the Tapioca name and logo belong to Rainforest Apps and are protected by law. Apart from the licence in the Apple EULA, these Terms don’t give you any rights to them. Anki, Quizlet, Mochi, AlgoApp, Mnemosyne, SuperMemo and Obsidian are trademarks of their respective owners. They’re mentioned only to describe compatible file formats, and Tapioca is not affiliated with or endorsed by them. Claude is a trademark of Anthropic. Apple, iPhone, iCloud and App Store are trademarks of Apple Inc.

If you send us feedback or suggestions, we may use them without any obligation to you.

9. Disclaimers

To the fullest extent permitted by law, Tapioca is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that Tapioca will be uninterrupted or error-free, that any content is accurate, or that using Tapioca will produce any particular learning result. We may change, add or remove features, including server features, at any time.

10. Limitation of liability

To the fullest extent permitted by law, Rainforest Apps will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to your use of Tapioca. Our total liability for any claim relating to Tapioca is limited to the greater of the amount you paid for Tapioca in the 12 months before the claim, or US$50.

Some places don’t allow these exclusions or limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived by contract.

11. Apple

These Terms are between you and Rainforest Apps, not Apple. Apple is not responsible for Tapioca or its content, and has no obligation to provide maintenance or support for it. Rainforest Apps, not Apple, is responsible for addressing any claims relating to Tapioca, including product liability claims, claims that Tapioca fails to meet legal or regulatory requirements, consumer protection claims, and claims that Tapioca infringes someone’s intellectual property. If Tapioca fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Tapioca. You confirm that you’re not located in a country subject to a US government embargo or on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of the United States of America, and by the laws of the state in which Rainforest Apps is based, without regard to conflict-of-law rules. If you live outside the United States, you keep the protection of any mandatory laws of your country of residence.

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision isn’t a waiver of it. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of the business.

13. Changes and contact

We may update these Terms from time to time and will change the effective date above when we do. Where a change is significant, we’ll let you know in the app or on this page before it takes effect. Continuing to use Tapioca after changes take effect means you accept them.
